Hello admin who banned you here! Im going to start off with the situation, the arrest was not the issue, It was the way you handled in cells. He asked you if the charges were misdomeaners, you crouched a few times (the universal yes). Thats where me and multiple other staff decided it is powergame. Powergame is the forcing of RP on someone, you forced the RP of becoming a felon and decided to try and make him think that he wasnt going to become one. This was after you learned who he was. Second, after you charged him with a felony you giggled about charging him with a felony, you knew what you were doing. Third, I consider the last year for notes, which you do have a powergame note! Fourth, as a staff we don't have to sit and argue for 20+ minutes in a sit, when we believe that someone has broken a rule, we can ban them and argue it out on forums! Not at all, i actually asked my supervisor at the NYPD the exact same question today and even he couldn't give me an answer. I genuinely asked because I was curious and it actually made me wonder, like how can someone receive a Rape charge when ERP is not allowed? I had no other intention behind asking so if i bothered you with it my apologies, also thanks for your answer & explanation

There are a few charges that don't typically have massive gameplay implication and are seldom used. State terrorism, resisting an INS offical etc. It's on there because whoever created the penal code added it. A criminal code would have such a crime and as an exercise in world building, it makes sense. It also being a roleplay server, there may be a reason in a story or event for police to do such a charge without any ERP actually occurring. To state the obvious, no you cannot ERP on this server, there is no special circumstances where it would be permitted. Doing a cringe /me to try to get this charge is likely to get you in trouble with staff and would be fail-rp/powergame ( making it invalid ) .

I mean you could see the difference as ERP being 2 parties engaging, where rape is one person having unconsensual intercourse with another. so ERP = 2 willing participants; Rape = 1 non-willing participant if im correct you cant even charge someone with that with the jailor NPC Also please dont rape anybody in game

Hi, banning staff here. You and your friend were, for some reason, attacking Pedro with a knife. Even before that, you and your friend ran up on him at the ATM. From what we can tell, you both tried again afterward, which ultimately led to the clip we see now. The clip you provided was also clearly edited to only show you running over to “save” your friend, leaving out the events that led up to it. If anything, this situation should’ve been considered NITRP based on the context leading up to the clip.

aight i have a very valid question that im genuinely curious about, as far as im aware ERP isn’t allowed on Diverge and is one of the most heavily disliked forms of RP However there is a Rape charge listed in the Penal Codes, how does that work exactly? What is the fine line that distinguishes the two?

I'd also like to point out that Redeemer is a former Detective and currently a Senior Officer meaning he should be fully aware of the charges and their consequences. They chose to mess with me alongside their friend out of nowhere and no reason and whether intentionally or not they ended up committing IC crime in the process. I genuinely don't understand how I’m the one being held responsible for the actions they chose to take. He specifically asked me whether the charges were felonies and before i could even answer him he signed the plea deal himself. I genuinely don't understand why y'all are acting like i held a gun to his head and forced him to sign the plea deal and make him a felon If I genuinely had any intention of Powergaming in this clip, why would I choose to do it to the guy who barely even said a word to me instead of the guy who was actually yelling at me, calling me a pedophile and disrespecting both me and my country?

For the past 12 hours, I had been continuously playing on my Officer character, i was taking a random individual to the NYPD to arrest him for "Failure to Comply" when Lucri a Supreme Team member who clearly dislikes me and was repeatedly yelling at me started following me along with someone i didn't recognize at the time. Neither of them had anything to do with the situation/arrestment yet they followed me all the way to the NYPD for some reason which i dont have any idea of. While I was taking the original suspect inside, one of the individual from the crowd kept blocking my way to NYPD. I gave him multiple lawful orders to stop but he continued so I arrested him for Obstruction of Justice, after he spoke in the cells i realized he was Redeemer (someone ive recently had OOC issues with) His first response was "I need a supervisor" Luckily Big Boss Jamal Lee was online so i called him through RPD and he came to the cells, he first asked me "What the charge was and how the situation happened" After i explained everything he said "Yes, what he did is Obstruction of Justice. Let me speak to him, give me a moment" He then spoke to Redeemer privately for around 10 minutes, came back out, confirmed there was no issue with the charges and told me i could continue the arrest. I went back inside and asked "Do you want a plea deal or do you want to go to court?" He said he wanted to go to court, so i left the cell. As I was closing the door, he said "wait" so i opened the door again. He asked to see the plea deal again, so I offered him the same deal "Obstruction of Justice and Resisting Arrest - 10 years" He told me he changed his mind and said he wanted to sign a PLEA Deal instead of going to court. He then asked "Neither of these charges is a felony, right?" after that question i Alt Tabbed to check the [DV-N] NYC Central Hub Penal Codes and when i returned to the game i saw/realized that he had already signed the agreement which i offered him just 30 seconds ago so i just closed the cell door and sent him to prison through the NPC and continued my patrol RP (Afterwards) Around 30 minutes later, Ka1 pulled me into a sit and told me he believed i Powergamed???? the issue is that I never sought out any of these interaction. I was arresting a completely random person and minding my own business/rp when Supreme People inserted themselves into my RP and followed me for absolutely no reason. I never contacted, approached, or interacted with them in any kind of way AT ALL. Redeemer repeatedly obstructed me despite multiple lawful orders so obviously for that reason i charged him for the crime he was actively committing IC Ka1 told me he believed I Powergamed because I had OOC beef with the guy, despite the fact that I had absolutely no idea it was Redeemer until he spoke in the cells. After getting out, getting a new PC, and coming back to the community, it was nice seeing that I still had a server and community I could come back to. Now that I’m getting settled back into normal life and going back to college, I feel like it’s a good time to finally apply. I’ve spent a lot of time just playing and being part of the community, and I’d like to start contributing in another way by helping players and taking some of the workload off the current staff team. Why should you be considered over other candidates?: The biggest thing I can offer is activity and availability. Outside of work and going to college full-time, I spend a lot of my nights playing on Diverge, so I’m already around the server pretty consistently. I also have a lot of experience with Garry’s Mod in general, and I’ve been around RP communities long enough to understand that staffing isn’t just about handing out punishments. I think being patient, listening to both sides, and knowing when something actually needs staff intervention are equally important. Do you have any previous staffing experience? (Please list where, what position and how long): I’ve previously played and staffed within a few Star Wars RP communities as well as another Mafia RP server. It has been a while, so I don’t want to exaggerate or make up exact positions or timeframes that I don’t remember. Most of my experience with administration today comes from having spent roughly 8,000 hours in Garry’s Mod and being familiar with how SAM, NutScript, logs, tickets, and general server moderation work. If so, why?: N/A Would you say that you are well known in our community, what’s your reputation, what do other members think of you?: I’d say my reputation is probably somewhere between respectful and neutral. I’m not going to claim that everybody on the server knows me, but the people I regularly interact with generally know me and I try to keep those interactions positive. What is your favorite moment on Diverge so far?: There’s honestly too many to really pick one. I’ve been in the PD, played Scottish characters, Russian characters and now I’m around Little Italy. Most of my favorite memories are probably just from the random situations and people I’ve met through all of those. That’s probably a big reason I’ve kept coming back to the server anyway. Have any staff members recommended you? If so, list their names: None to my knowledge. ⸻ Problem Solving Someone RDMs and you are currently off-duty. How do you handle this?: First I’d make sure it was actually RDM and not something I saw without knowing the full context. Just because I watched somebody kill someone doesn’t automatically mean there wasn’t an RP reason behind it. If it actually looked like RDM and another staff member wasn’t already dealing with it, I’d go on duty and handle it normally. Get both sides of what happened, check logs/evidence and go from there. If they did RDM, I’d give whatever punishment fits based on the rules and their previous warnings. You have seen a fellow staff member of higher or equal rank than you abusing fairly often, but never doing anything too noticeable. What do you do?: I’d probably start recording or keeping evidence of what’s happening first. I wouldn’t immediately go around accusing them of staff abuse if I couldn’t actually prove anything. If it keeps happening and I have enough evidence to show there’s actually something going on, I’d bring it to whoever is above them or staff management and let them deal with it. I also wouldn’t confront them in front of players or start talking about it with everyone else because that’s just going to create unnecessary drama. Their rank wouldn’t really change anything for me. If they’re abusing their position then management should know about it. A member of your faction / friend of yours has a ticket made against them accusing them of RDM’ing, and minging. You know that this person rarely does this when you play with him. How do you proceed knowing this? Does it constitute possible bias?: Yeah, there’s definitely a possibility of bias there. Even if I don’t mean to be biased, knowing the person and already thinking “he normally doesn’t do this” could affect how I look at the situation. If another staff member is available I’d probably just have them take the ticket. That removes the problem completely If nobody else can take it and I have to handle it, then I’d handle it like any other sit. Listen to both people, check logs/clips and make the decision based on what actually happened. If my friend broke the rules, then they’re getting the same punishment somebody I don’t know would get. Being my friend or being in my faction shouldn’t get them out of a punishment.
