I am choosing the apologetic approach because I failed the community, Canadian, and Pendred. I did well in the beginning but after that period I immediately got back into the stuff that consistently got me in trouble whether it was IC or OOC. I got bored and I sought out shootouts, robberies, and PK's. In general I just showed a lack of fear of consequence to my actions and it showed with the consistent notes and bans. I admit that the last ban I received which is the one I am currently under was metagame as I intentionally avoided an RP scenario for one of my other char's benefits. In agreeance to James I began to repeatedly show that I treated this server with unseriousness and this last Metagame was the straw that broke the camels back and I am not going to refute it. Addressing my constant rule breaks is half the picture, what really matters is that I returned to my old ways that I said I moved past and I will list them out. Here is a photo of my total notes and bans: Muggings and Instigations: I always wanted to pursue muggings, raids, and shootouts because it provided a source of entertainment and fun that I couldn't get from regular griding. After I was unbanned I stayed far away from instigating any shootouts at all and I halted mugging all together. For that nearly 2 month period I was entirely clean. I then learned more about the loophole of "being damaged by an officer negates any fear rp and instead makes it a death match" so I began regularly doing it on my taka char which was my main. I remember that I was told by my captain at the time, thinner, that I would have been made if I did not kill cops as much. I was already being shown signs that my actions were interfering with roleplay but instead I continued out of selfishness to pursue my own fun. Many people including staff have insulted me by stating I don't have the ability to sit still and the truth is I don't. Even Darkfire who was very supportive of this clip said that this was a pure nigga moment. Mugging was never about me getting clothes or drugs it was more about increasing my ego. I'm not going to try to sugar coat it or anything because I never wore the clothes I got from robbing aside from the NASA spaceman suit because it looked stupid and the Feds polo I got from a Cassano. Most of the time I did these things out of selfishness and me wanting to increase my ego. I recognized it at the time but I always dismissed it and claimed that it was for profit. Now that I have seen the consequences to these actions I am able to say that I regret doing these things and I apologize to the people I have harmed while doing this, especially to the new players I knowingly lured to take drugs off of which ruined their perception of the server. A lot of these things I still do to this day on servers like Perpheads and Prometheus because in all honesty its stuff that I enjoy but I have gotten burnt from consistently playing on the same server and seeing the same things happen the same way trough weeks and the thing is that these servers are built for conflict and that serves as its only purpose (Prom more less than Perp but it sees constant shootouts), diverge requires actual roleplay. Although yes I enjoy shootouts I feel like I don't gain as much anymore from the constant-ness of just always having to do something, this is a main reason as to why I'm burnt from perp. I don't feel like I want to nor need to do it as much. Going OOC and general shit talking: As I have said multiple times before I have a bad habit of speaking without thought and usually this would involve me going OOC. Since by definition Metagame is using OOC information (regardless to gain an advantage or not) it's still a rule break. Of course in the past I have said that I would work on it such as in this appeal and then I proceeded to do the exact opposite and instead continue with my talks about certain people and what they have done. Especially towards MXR, I consistently talked about a subject that I personally feel should be widely known but regardless in a server setting all it would do is create unnecessary drama. All of my negative talking did was create drama and I knew this. I apologize to the people I harassed or painted untrue pictures about such as the owner of the NASA suit who repeatedly showed he wanted to get me permanently banned for bringing up accusations. Minging: I feel like this deserves its own section of addressing because I would constantly get described as a minge. Truth be told I rarely followed RP unless it was police RP or I was in a made man activity/meeting. Even on my Lucchese and Taka char I would sometimes dress like a retard and go out to seek conflict from acting stupid. I can also recall getting on my brown and sons char and going up to Bonnanos and doing "/me shakes big jiggly black ass a lil" and then running away once someone mentioned it. Along with this I did add the Dave Blunts suit in and I'm still amazed that Pendred did accept it and im really sorry to Anzati because I know he had to pay a good amount of money to get that added in. I did it all of this cause it was funny to me and I know it was weird and extremely stupid but like all of these other things I found enjoyment trough it. Regardless this wasn't a correct of way of rp'ing at all and I apologize to the people who I 100% weirded out and ruined the immersion of. Hacking: I feel like I need to talk about hacking because at the time of me playing the server there would be a lot of people stalking my medal. Although I do not exactly need to speak about this I still feel as though I should make a mention about this suspicion of me, it can weigh a good amount on if I do make a return or not. I have never cheated on a single Garry's mod server throughout the entire time of me owning this game and although in the past I have stated that I will ESP in a war that was not meant to be taken seriously. I honestly do understand were some of these staff are coming from because from a third person point of view and without my thought process it may seem as though im ESP'ing and even on Prometheus I 1v6'd and I was immediately met with aimbot accusations but the truth is I never have nor I never will inject any cheat especially on a server I have invested a lot of time in. I have a fear of doing something that can compromise my personal security online and installing a cheat and injecting it is too much uncomfortably for me to deal with. Now that these things are out of the way I want to talk about why I want to come back right now Why I am so desperate for this appeal to get accepted: To put it bluntly, obviously at a time like this in server were all this conflict is going around I want to return. The things that are happening right now are things that I dreaded to do and I feel as though making a return at this time would extremely good for my betterment as a role player solely because it will get a lot of things out of my system such as toxicity and I will finally be able to get the closure of participating in an active conflict instead of going out and selfishly making one myself out of boredom. This is the main reason but it's not the only one. I have recently been stalking the updates that this server has received and medal clips and I have heard a lot of things about the additions to evidence RP as well as the map. I know that places like Little Israel have changed entirely and ghetto has received extensions. Weed has also been changed to a nearly manual process, instead of having to water and go afk for 5 minutes there are more steps to it. PK's leave a mess now with a whole dead body spawning and there being good ways to get rid of them, you must pick up physical casings instead of having to do a /me, and black gloves have been added to remove the possibility of fingerprints being left in a crime scene. There has also been more quality of life updates and an issue I found myself constantly running into was having my stamina never regain when getting into a car and I'm glad to say that that issue has been fixed. I miss this server for a lot of things because of it's uniqueness and there can never be a server to replace diverge in any of it's aspects. Simply put, a car wash would be a great addition to the city. A good job for civs or even side job for crims/off duty LE/government. A lot of us RP getting gas and other things with our cars. It could be a great meeting place for people. Socializing or even solo RP, a reason to "make a quick stop" or even somewhere to do a quick deal "hiding in plain sight". When recruiting people, you might have someone train for you because you're a lazy sack of shit. Sometimes these trainings might not be done properly, yadada, and thats purely the fault of who told you to train right? But what happens in the case of people who don't get invited to the faction discord for example. Crucial step right there, because now you have an un-tracked faction member that can do whatever the fuck they want. Im yapping, heres my proposal. A faction "lock-down" option to whitelisting. Factions may choose to enable or disable this, basically it will not allow anyone to be whitelisted to your faction (staff cannot whitelist TO faction) UNLESS you have C menu recruitment permissions. This will stop the leak of random low level associates/interns from being able to just go "@ whitelist this guy" and causing problems, under the faction whitelist. Maybe I'm just a horrible faction leader idk, but I've caught a bunch of people just blatantly racket abusing recently in my faction (Brown and Sons Co.), yet I cannot do anything about it, other than just unwhitelist them and get staff to note/ban/punish etc.

The reasons surrounding your orders were shaky to begin with so an investigation was opened with extra scrutiny. When conducting said investigation, it was found that your leaving the faction had been metagamed from an OOC Discord call. They also had no evidence for the other claims of why you were PK'd. For these reasons, those responsible for being malicious in using the metgamed info for your PK have been handled and your character has been restored. Your appeal has been reviewed and accepted. Your character has been reinstated and can be used again.

Hey, Don of the faction in which you were pked out of here. Even though I wasn't the one to write the orders personally, I'll leave a little comment for any reviewing staff to see. As Toast already mentioned, the main reason for your death was due to you leaking sensitive information, about which I had heard multiple reports from quite a few of my guys. Rather straight forward there. In regards to all of the other things you mentioned, there is already prior precedent set for pks about messaging a person to meet up with them or to get online not being against the rules. If I can find the specific appeal in which Canadian made that comment, I'll leave it below in another reply. To say that things were communicated and planned OOC would be a lie. As I'm sure you know, I was also on the radio frequency that my enforcer was on with you when you were "looking for someone", and even spoke to you directly on said radio. (You weren't looking for someone, they were just killing you.) Your death was discussed leading to orders being given with myself and a few members of our command in-game also, and was not handled OOCly. I also find it hilarious that the moment you get pked you go on a schizo posting session inside of the diverge general chat on the discord attempting to leak more totally real information that you heard to who you think the targets are and you even end it with "if anyone needs anymore info lmk". Hello, I'm the admin that had pk'ed you. Just to say you were only pk'ed on your Lucien Dupont Character not your Alisio Ramano. It was originally going to be both due to you saying you had item transferred but with a further look into it you hadn't item transferred anything. The reason for your Lucien Dupont character getting pk'ed was because after 30-35 minutes of spectating you with a recording started you had broken 6 rules with 3 of them being Breaking raid timer, Mugging character and Failmug, with mugging 3 people in 30 ish minutes and 2 of them was in front of an NPC and the other was out in public

Ill first state that this kill was not coming from any escalation from any current conflictions going on in the server. This kill was not approved prior by UA as Money Blue alluded to above, but with that being said I will break down kill. Evidence was shown that you had been harassing the Kosher Deli multiple times and clearly had pissed some people off. So yes, you were a target, but there is a difference between targeting a faction for a mug, versus targeting an individual for a mugging because of his actions. While escalation rules may dictate the appropriate time a faction can target an enemy faction with mugging, the two factions are currently not at an escalation level, thus making your claim null and void. The muggers were on main characters, and YOU decided to chase them to a secluded location which on the mugging map is a “mug where you stand” location. Upon entering the back room you were confronted with guns to your face with the verbal command to put your hands up which would place you under FearRp. As stated in the rules : “Note that you must have a valid reason to place someone under FearRP (See FearRP rules), initiating a mugging is a valid reason to hold someone under fear RP”. If you read item 9 under mugging rules, it states: There are several ways you may initiate a mugging, the following actions can be considered initiation of a mugging: - Attempting to Zip tie someone [Does not apply if you BAIT people into tying you by saying they may or by stealing their items, therefore forcing them to tie you to retrieve them.] - Holding someone at gunpoint with the intention of mugging them - Holding someone at gunpoint to pull them to a secluded location for a mugging Thus making this a valid initiation of a mugging, as they were attempting for you to go back into the back room. You turn to leave and another verbal command of get back here was given, which was clearly heard in the clip that was provided. If we continue down to item 10 of the mugging rules it sates: When can you kill someone in a mugging for it to be considered a PK? - You must FIRST, properly initiate a mugging (See Mugging Rule 9.) - They attempt to flee while you have them at gunpoint/fear rp. (Does not apply if you disengage fear rp. See fear rp rules) - They attempt to fight back while you have them at gunpoint/fear rp. (Does not apply if you disengage fear rp. See fear rp rules) - They attempt to move or avoid being restrained while you tie them under fear rp. - If they disobey direct orders multiple times (while under fear rp) which leads to complications in the mugging. ex: Refuses to stay still and moves one or two steps at a time to try and escape, refuses to stop talking leading to someone overhearing the mugging. - They do not obey a reasonable demand in a reasonable amount of time. ex: Ordering them to follow you (while under fear RP) and refusing to move after several requests and a reasonable amount of time to obey, effectively stalling the mugging to be discovered. If we follow down the chain of events, the mugging was initiated correctly, you were brought under FearRp correctly, you decided to attempt to flee while you were under gunpoint/fearrp, thus making you PK active. From this clip I have provided it shows you stood behind a guy who was talking to a random white shirt who we now know is your friend who claims he doesn't know what he's doing on the server. You then randomly pistol whip the guy and when he responds to the threat your white shirt friend pulls out a gun and guns the other guy down. This is clearly RDM baiting as there's no reason to randomly pistol whip the guy other than to get a reaction from him so that your friend can kill him and then your friend screaming "get packed up again nigga" shows your true intentions were to just bait a reaction from the guy where you had killed him 6 minutes before this interaction. +1 could be cool to have to maintain the processor for return, missing a said action could cost you to get 8 packs instead of 10, like maybe every minute you have to complete something, and if you miss actions it will result in 2 being lost in each missed action.
