First off, when I was ban I was ban for Item transferring (there is a script to prevent it). Me and a long time friend and ooc family member wanted to test out the new PK script. He texted me one day and asked if I wanted to PK one of my old characters, i said why not because I was not going to use it anymore, and why not have a good rp with it. So what we did was I mugged one of their chars in the crew so then they would have a reason and they could get a good clip for an edit or YouTube video (not really sure what it was for either YouTube or something else all I know is it was being clipped for something). So then once everything happened and the guy I mugged got set free, I went to drop the stuff I took out of the guys pockets and dropped it. I know that the rule book does state " you may not transfer money or items between any of your characters in anyway. Nor are you allowed to act as the middleman for someone else's item or money transfer. Transferring items or money between two of your characters is not permitted under any circumstance." This quote says how any type/sort of item transferring is strictly prohibited no matter who your doing it for. I am wondering if we can do a zero tolerance policy/ 1 strike policy if you choose to remove my ban. I do understand it was wrong and I do understand that I have extensive POs. I know that what staff may see when they see my play time and my past POs may think that I am not worthy of being the the community but I owe up to what I did. It was a first for me, I have never item transferred before. I have tried to do any type of item transferring, but for some reason on this day I thought it would be a good Idea, I am not sure why and now I deeply regret it. I want to be able to come back and play with the people that I have played with for years from other servers and with people I have met in this server. I think I am ready to come back and that staff should take this appeal into consideration. Bullets gets whitelisted, I crash during the whitelisting, so I wasn't even shown anything such as drugs, Oil, guns or anything illegal. I come back on, get whitelisted, and the guy who hired me tells bullets to show me. Bullets doesn't even show me anything until I crash again, and then when I get back on, he's unwhitelisted by staff. So at this point, what's the point of me being in the faction if A. I haven't got my friend in there. B. I haven't been shown anything Illegal. C. I wasn't even shown anything or had any proper RP with the faction. So I just leave the Wl Without buying drugs, guns, Oil or anything. Since they already unwhitelisted the guy I'm with..... If possible please provide video evidence or photo evidence if PK does not follow the guidelines: N/A

First off, I want to correct myself regarding something I previously stated after you messaged me about the ban. You did not unwhitelist yourself willingly, as you mentioned in the appeal. You were unwhitelisted by the factions management after they suspected you of racket abuse, and they subsequently brought it to the attention of UA. As for the other points I made in our conversation, I believe they still hold strong. You joined the faction on a new character, and shortly after being whitelisted, you were given $65,000 from the don of your main character. After receiving this money you instantly ordered a striker and later gave it to him. You additionally provided him with another one afterwards as well. You claim you were unaware of any real selling price of one, despite their most recent message in their associates info channel stating something along the lines, “Don’t sell these for under 400k.” I feel as if you saying you didn’t read or see it is a poor excuse. You even admitted yourself that you aware of one selling previously for 200k. If you knew this and had what was essentially an unlimited supply, why would you only sell for 65k? Clearly, you could have gotten more if you had proper business and money-making goals, further showing you did not have real roleplay intentions for this character. While the rules may say that selling below a certain threshold constitutes racket abuse, the main concern I have with your actions, which led me to believe you were racket abusing, is the fact that you very quickly used your newfound access to sell to your main characters don, likely OOC corroboration there, for a price WELL below street. Considering all the information I don’t believe its unfair to conclude that you had zero intention of roleplaying on this character and instead created and joined this faction solely to exploit their weapons racket for the benefit of your OOC friends.

In the appeals process, every angle is looked at. You at your own volition joined a criminal family, and were given a prompt along the lines of "Anything you do is PKable, you are now at great risk". While yes, as per rules this is not a raid. But you did still force yourself into the place. The killer had given you an option to leave, with his gun pulled prior to yours being pulled, then you pull yours out and instantly start shooting. PKing rules also state You were given a chance to leave the scene after the Ranger was pulled, yet you decided to pull out a gun and try to fight it out. Multiple permanent bans on record, and you don't seem to be improving, you just seem to be not getting caught or simply not playing as much. While yes, you do have 36 days playtime, as a staff member when taking PET flags we need to judge if you deserve them, or truly meant mal-intent. In this situation, as you say 'I was just high', is not an excuse. If you cannot handle your substances, you should know better to not get on the server at all. PKing admin here, If the note was invalid, then it would've been removed. If it was 'approved item transfer' (literally not a thing), then it should've been appealed through the proper routes. Notes are not warnings, they are simply notes to put on a players record to give future staff members an idea of what type of player they are. Notes do not always consist of rule breaks, but the large majority of them are. Now onto the actual PK, here's a lot of screenshots so stay with me here gang. First image, you admitting 'I just mug people for a living'. A mugging character is defined as, using an alternative character to intentionally avoid losing any sort of items, or mugging without risk, it is also seen as making mugging your sole roleplay experience on said character, if mugging is your main goal of a character, you are not contributing any roleplay to the server, other than to ruin other players time/experiences on the server by constantly putting yourself in no risk, high reward situations. I was mistaken, it was not 6 muggings, but 5 and one of them was double tied for whatever reason. Now now now, stay with me here, this is only the successful muggings where you tied up the person. If we look at your kill logs WITHOUT doing anything under assumption, you made a PK ticket for one of them, so its truly 6 muggings and some spare change. But then I notice you killed two of the people you had kidnapped? Which is against the rules also. But I'm not speculating so I won't hold it against you, but it does add to the story of you being a mugging character. Onto the next, Here are all of your money logs for GIVING money. Yet you were given 4 makarovs from "Tito Dick" I did not punish Tito Dick because it was only 4 makarov's, if it was more severe character abuse/racket abuse, they would've been pked also. But it all boils down to the fact that you never gave Tito any money in exchange for 4 firearms, when you are also not in a faction, nor have any sort of gang affiliation so you cannot call this a "simple favor". Here is another chat log of you admitting that most of your belongings are from mugging. This is a roleplay server, not a PVP server nor a FiveM 100k or die server. This is all to build character lets say. It is not me being bias because I do not have a single clue who any of you are, I'm an "old" player from 2021, but I only played for a couple of weeks then came back a couple months ago. Nothing from these screenshots created any sort of bias or speculation, the reason for your PK was based on pure factual information (logs) which never lie. Your sole intention of creating this character "Tungee Royce" was to mug people, steal their items, until your faction got added to the server, while other players genuinely do play the server consistently and instantly gain more money. There are better ways to build a character, especially if you're creating a faction, that reputation of 'only muggers' will follow you. (There is a very large difference between what you do, and what Leon currently does on the server, because they do still contribute roleplay while their faction does allow mugging people). Like I said earlier in the appeal, you are giving yourself a Low risk, high reward character for "fun". It is not fun when others experiences are ruined by yourself, just because you don't take the server as serious as your victims. Side note, considering I just recently found out you come from 42rp, being called a degenerate is not the worse thing that's come to you. Don't act all high and mighty like you haven't said or meant worse before, yes it was a little unprofessional on my end, but when you are an old player it seems, and so genuinely un-educated on what the server is meant to be/what the rules say and define, sometimes it happens. After further investigation, you were released by a Corrupt Cop who was already dealt with in character. You had zero power over actually being released therefore you cannot know when you're allowed to leave or not. I spent so long trying to compile the clips and I just gave up, banning admin here, Your story starts when I begin to noclip around you instead of using the spectate command. (I was watching for almost an hour before! wow!!!) Literally just going to copy paste all of the text I had explained to others if you could reply with each one of the situations and why you think you're not cheating that'd be great. I had ---- shoot him from the roof tops in the leg, he then later said to the cops “why are cops shooting me from the roof”, when there was no indication it was a cop (He said flashbang, but from the spectating POV, I didn't see anything, and neither did his clip) He then goes into the sewers and he’s constantly turning around to see through the walls where the cops are and how close they are, out of render distance he finds a dark corner and sits in it waiting for them to pass right when they're about to catch up to him. Then I get ---- to shoot him in the leg again from a rooftop, and he makes a ticket asking why civis are shooting him in the legs from rooftop (---- was on a civi this time) THEN the final straw No lock picking or anything, ---- was standing outside of the guys ghetto room, and he’s running around and preparing for a gun fight (esping), ---- starts to lock pick and he instantly readies his gun He wasn’t silent aiming in the last one, but he def knew he was there without making any noise He also says the appeal starts when the cop shoots him, and that’s when I started noclipping around him on purpose. oh another super interesting one i forgot to say, when i was spectating him (before i started noclipping around him on purpose), he was bragging how he was the best shooter ever in diverge history and that if any cops tried to arrest him or his friends, he'd win the gunfight, then when they're in a townhouse, not even like 5 seconds after starting another conversation, he goes "oh shit, i think theres cops outside", no sirens on or anything, and a cop is sitting in a bush outside of the window (not visible from garage, where he was standing.... duhhh) In the end, I was not trying to bait your PSilent aim (from the original PK clip), but I was trying to bait out ESP behaviour, in which I saw you follow multiple times. "Randomly" doing a 360 to look around you, or looking in the general direction of where someone is shooting you from, but never directly at the person. You act as a csgo player trying to seem legit, but I can tell you're not by all these little hints and movements you do, the biggest and most obvious case of the ESP was in the sewers, when out of render distance, cops don't even turn the corner yet, and you instantly know to hide in a dark area of the sewers? But the second they DO peak you, you're staring directly at them (still out of render distance btw). Yes, I did read most of the appeal, but it does genuinely start where you talk about being shot from the rooftops, there is a whole one sentence about the townhouse situation when that was almost a quarter of the spectating time.

The problem here is that you have EIGHT PO's within 3 months. If your ban gets reduced or removed, whats stopping you from just doing it again? You seem to never learn and constantly put yourself into situations where you're in the wrong and get punished for it.

Banning admin here, As a cop you need to make some sort of arrest attempt, as I stated in the admin sit. This was a non-violent crime and you instantly resorted to your firearm. Once again, the van is no collided, the van did not try to run you over, the person was committing a non-violent crime, the person was not a threat to you or public safety, the van stopped multiple times and you continued shooting, you could've done /doorkick multiple times to kick them out of the vehicle. PET Flag taking admin here (this is basically just an explanation from my side so the appeal is fair and decided properly). I first received a report about some flags blocking the alleyway. So I tracked down who it was, it was you. You were AFK and I tried talking to you and no response, I didn't PM and I agree that was my fault. . I then get another report about the same type of props in the area, but instead they were short poles.... When I figured it was you again, I tped you, and you almost instantly removed the props when I asked "whats up with the props in the alleyway again?". (Almost like you knew it was wrong) During the sit, you had brought up you put up those props because people were 'revving their cars'. This to me, I saw it as you were avoiding the confrontation roleplay by placing props down (PET flag abuse)... You then continued on to say 'other people are doing it', but yet, you didn't create a single report because you said, and I quote, word for word, "because im not a sissy crybaby". More points during the sit, you had said you have never had a note before, yet you had 3, one specifically for Prop abuse on June 13th. Less than 2 weeks ago, when I questioned you on why you simply respawned it, you had said you were placing dupes and just conveniently placed them again, yes I admit it was my fault for not pming you to not do it, but you continued on to say that it was 100% allowed because a Moderator (morty & byte (if im correct)) had said, less than 15 seconds before me pulling you that you were allowed to build there, but not prop block it to cars. I never once pulled rank on you or the moderators, but I had stated that just because one staff member said it 15 seconds before I brought you to the sit, does not mean my entire word is invalid. Ontop of that, what they said (yes I was there), was not even remotely close to "You are allowed to prop block this alley way". Genuinely, you talked yourself into getting your PET flags removed. I gave you time to calm down and have a civil conversation but you continued to yell over me and call me names, I was trying to give you a chance but you continued to lie and disrespect me. They’d put on shows at the campus to the other students, the main coordinator was a fella called McGuff. Even in college, they would be surrounded by crime, it paid well so it was worth it, especially going through college everything was so expensive for these clowns just trying to live. After hearing from a friend about how much exactly crime had paid out, McGuff proposed the idea to the group of clowns after a long night of doing gigs. They were sick of birthday parties, and making a fool of themselves on stage, on purpose. McGuff heard from his friend there was a job going down in the next 2 days, it would be a massive drug deal and they needed lots of hands on deck to move the product. The clowns gathered the night before, and couldn’t figure out what to wear to mask their identities if anything went wrong during the deal, so they did what they do best, dressed up as clowns. They headed off to the deal in as few cars as possible so they wouldn’t expect anything to be off. Once they got to the deal, there were some questions thrown around, McGuff’s friend’s name was thrown around along the lines of “When he said there were some new hired, didn’t know they’d be literal clowns! EH!” The clowns took this as disrespect and thought it was the best opportunity to take their name to the streets. Sally was so chaotic and easily outraged, that when she pulled out her Colt M45, pointed it to her own head while screaming, and then out of nowhere, shot 2 of the dealers. That's when they returned fire, Sally was then killed right then and there on the spot by a man in White and Black. The rest of the clowns later that night, went home victorious but mourning their friend, Sally. They had so much product they didn’t know what to do with it, so they started asking around for connections. It was so dead for so long that they all went back to their original plan, acting as clowns for entertainment. During one of their birthday party gigs, they heard people talking about how they heard a shooting at a warehouse, and apparently, some clowns were involved, the problem with crime, is that word spreads fast. For the clowns, this wasn’t a problem but instead was an opportunity, after the gig, the clowns asked the old men who were talking about them how they heard. After hours of conversation, the old men eventually gave up that they were also in a crime family. Later that week, the clowns set up the deal with the old men, they met up with their sons of the family and traded all of the product, that's when they were introduced into the underground of Southside, and after that, it was all up and up. The clowns organized more, continued gigs, and recruited more members, it was an amazing front for laundering money. His gun was on safety for a solid second after you decided to shoot and pointed it very clearly away from you. The victim is NOT the one who should be telling you commands. You are the police officer, you are supposed to take charge of the situation, like in real life. In the victims head, just think about it for a second, he thought, and was, in the right, he wouldn't be held up to the expectation of "I need to tell this guy I just did right", because as an officer, you are meant to analyze the situation. Your PO's simply reflect what type of person you are. And you showed it time and time again that you are trigger happy. He had a single fire glock, at most he'd be able to injure you before you got 1 shotgun shot off and killing him. If he was truly a threat, why didn't you make a pk ticket to get this guy's character pked? Because he was not a threat nor did he ever fire at you. He put his gun on safety as fast as he could because a lot was happening at the time and he probably handled it the best out of anyone there by putting his gun on safety after realizing you were a cop. I mean this in the least disrespectful manor ever, but have you seen any of your hostage "negotiation" clips? 80% of the time, its someone already dealing with it or a non-threat hostage taker, you walk in, shoot them, walk out, call it a day.

If your vehicle was genuinely stuck, in which it shouldn't of been in the first place like you an I both stated, you should've called staff. But you didn't and here we are now. You entered at your own will and disrupted other players roleplaying experience and you do this on a daily basis. If you entered at your own free will, and couldn't exit, you would've called a staff member if your intentions were anything but malicious.
