You are entitled to your opinon but my ban history isn't relevant to the allegations being put against me within this ban. The purpose of an appeal is to establish if a rule violation occured. Not to decide if somebody is should be permanently banned from the server, based on their reputation. Also the voice changer is a seperate issue from wether the shootings constituted RDM or not. Taking two different grievances & combining them together doesn't establish that the alleged RDM took place.

I just want to emphasize how the initial first contact was made between me and these individuals. The two individuals approached people in the vicinity of Blue Lobster offering services related to ERP.I made a joke in response to what they said, which then developed into them beating me with their fists.

I appreciate you taking the time to explain your reasoning. However, I still disagree with the basis of the punishment, particularly how the two reports and my previous history were used to reach the decision. Firstly, the fact that two separate RDM reports were submitted does not inherently establish that RDM occurred. Both reports originated from the same confrontation, involving the same two individuals. As I explained in my appeal, I was followed from Blue Lobster toward the fighting arena, repeatedly assaulted, threatened, and pursued despite attempting to leave the situation. These circumstances are central to understanding why I used my weapon. Second, I also want to address the reliance on my previous notes and ban history. I understand that staff consider a player's disciplinary history when determining appropriate punishments. However, I believe there is a distinction between using someone's history to determine the severity of a punishment and using it to substantiate an entirely new allegation. My previous offenses do not establish that I committed RDM in this particular situation. Third I find it concerning that the accusations made against me were treated as sufficient grounds for punishment despite my disputing their accounts and explaining the circumstances leading up to the incident. I maintain that their accounts misrepresented what happened, and I do not believe the fact that two reports were submitted makes those accounts accurate. Ultimately, I am not disputing that two individuals died during this encounter. I am disputing the characterization of those deaths as RDM. I would appreciate clarification on what specifically established that my actions violated the RDM rules, independently of my previous disciplinary history. I believe that is the question that needs to be addressed before the punishment itself can be justified.

Jeff Bolivia | Killerbugjuice38 STEAM_0:0:635365790 1373540534521565205 / krueger__. RFB: "rdmx2 | "Voice Changer Cringe" | Multiple PO's/Bans" Duration: 1W Reason for appeal (dispute/apology): No clip, Fabricated. Why should you be unbanned? Grounds for Appeal I am disputing this ban because the reports made against me contained deliberate falsehoods about the incident. Both individuals accused me of wrongdoing while omitting the circumstances that led to the confrontation. My account is that they followed me from Blue Lobster toward the fighting arena, repeatedly assaulted me, threatened me, and continued pursuing me after I attempted to leave. I did not randomly approach and kill these individuals without cause. During both staff sits, I disputed the accusations and explained my account of the events. However, I was not shown a clip substantiating the reports. Instead, the situation progressed to a ban, with my previous offenses also being brought into the discussion. The reports misrepresented what actually happened, and I dispute the decision to characterize the incident as RDM. Previous offenses do not establish that the allegations in this particular case are true, and accusations should not be treated as established facts simply because multiple people make them. I am requesting that the ban be reviewed based on the specific events in question, the contradictions between the reports and my account, and whatever evidence was actually available to staff when the decision was made. I stand by my account of the incident. I was falsely accused, and I am appealing this ban because the decision does not accurately reflect what occurred.

I understand the reasoning behind the decision, but I disagree with the characterization of this as RDM. The shooting did not occur out of nowhere. The interaction had already begun near the Car Dealership, where the Trackhawk driver engaged with me and Joe Dirt and the situation escalated into hostility and threats. We subsequently left the area and went behind the Casino, but the same individual continued following us. This is the reason my friend questioned him by saying, “why are you following us man, like we are some kind of attraction man.” His continued following us is important context. We were not randomly encountering an unrelated player and shooting them without prior interaction. There was an ongoing confrontation between us, and we had already attempted to leave the original location before he continued following us. When he responded with “I'm not worried, bitch out man,” I interpreted that response, combined with the preceding interaction and his continued pursuit, as an indication that the confrontation was continuing rather than ending. I therefore fired because I believed the situation was going to continue escalating, additionally I could not see what guns on his back he had as he also had tinted windows. I understand that the clip does not show me giving multiple warnings, and I am not going to claim that I remember giving specific warnings when I cannot verify that. The incident occurred two days ago, my memory of the exact sequence is imperfect, and unfortunately my Medal TV directory is corrupted, meaning I cannot access my own recording to verify the interaction. However, the absence of a warning in the available clip does not make the shooting a random deathmatch. There was an established interaction, continued pursuit after we left the original location, ongoing hostility, and a confrontation immediately preceding the shooting. Those circumstances are fundamentally different from randomly killing another player without prior interaction. I also want to address the suggestion that this was a “crash out” because I had recently been PKed. That was not my intention. I was genuinely concerned because my character had been targeted by numerous people previously, and I believed this was another situation in which someone was deliberately following us and looking to continue a confrontation. My decision was based on that situation, not retaliation for the previous PK. I believe the appropriate question is therefore not simply whether the available clip shows a warning immediately before the shooting, but whether the shooting was an unprovoked and random killing. I do not believe it was. There was a continuous interaction between the parties, we attempted to leave the original confrontation, and the other player followed us and continued engaging with us. For those reasons, I believe the incident should not be classified as RDM and I respectfully request that the ban be reconsidered.

Michael Bolivia | Killerbugjuice38 STEAM_0:0:635365790 1373540534521565205 / krueger__. RFB:RDM, Extensive PO's. Duration: 1W I would like to dispute this ban because I believe important context surrounding the incident was left out. The incident in question occurred two nights ago near the Car Dealership. I was with my friend Joe Dirt, and we were walking around and talking when a grey Trackhawk approached us. The driver initially began talking with us, but the interaction escalated into insults and eventually explicit threats to kill both me and my friend. Because of this, we attempted to disengage from the situation rather than escalate it. We walked away from the Car Dealership and continued toward the area behind the Casino near the benches and parking lot. Despite us leaving the original location, the Trackhawk followed us and continued making threats and insulting us. At that point, I believed the situation had escalated beyond simple verbal harassment. The individual had followed us after we attempted to leave and had repeatedly threatened to kill us. I did not know whether he was armed or whether he intended to act on those threats. Because of this, I believed there was a legitimate possibility that the situation would escalate into an actual attack. After the individual continued following us and making threats, I drew my weapon and fired. My intention was not to randomly kill or RDM the individual, but to protect myself and my friend from someone who had followed us while repeatedly threatening our lives. I understand that, without the preceding events, the shooting could appear to be an unprovoked attack. However, I believe the preceding threats, pursuit, and continued harassment are important context when evaluating what happened. I also want to point out that I was banned while I was not in the server, meaning I was not present to provide my account of the incident or respond to the accusations before the punishment was issued. I am therefore asking that the incident be reviewed using the full context, including any available recordings, witness statements, logs, or other evidence showing the preceding interaction. I understand that firing a weapon and killing another player is a serious action and I am not claiming that the situation cannot be reviewed. I am asking for the circumstances leading up to it to be considered rather than treating the shooting as an isolated RDM incident. Based on the threats, the continued pursuit after we attempted to leave, and my belief that the individual intended to escalate the situation I request that the ban be reconsidered.

Neutral I think it would be interesting to bring in new cultures.

I would like to mention you haven't talked about me being banned for "LTAP" and reviewing the clip. I would also like to add that you did not inform me about the problem with the props you just deleted them. I would also like to add that the roleplay was legitimate, I was roleplaying as a native American and put down teepee's for me and my friend. When you removed them I moved it further. Taking into account my Past Offences is just a swaying factor in deciding it has nothing to do with the dispute I am currently making. If you *actually* reviewed the evidence (the clip) you would see that I didn't just vanish. I was disconnected. This quite frankly doesn't cover anything and I ask that you properly review the clip before saying that I "vanished". If you would like to display any of your own evidence to back up your claims I would be glad to see what I've done that was wrong except place down two tents and be co-operative with you in a staff sit and get disconnected from a glitch.

Your Character or Steam Name: Killerbugjuice38 Your SteamID: 76561199230997308 Your Discord ID#: lost_memory. ( I don't know how to retrieve my id) Reason for ban: " Prop Minge - LTAP " Length of ban: 2-Days Reason for appeal (dispute/apology): I am making this dispute for the reason I was banned. I was banned for the reason of "Prop Minge" And "Ltap" Both of these factors I was not in control or unaware of. Why should you be unbanned? I believe I should be unbanned for the reason being that I have made a ticket in the discord to ask about the legitimacy of the ban. I was told that spawning in a fort/tent in city hall is not considered prop abuse. When the staff interaction first began, I was with my friend outside of a restaurant where I had spawned in two Tents. I was told it was an hinderance of the entrance to the restaurant. I complied and removed the one closest to the door as not to cause issues while keeping the second tent which was further from the door. That is when a staff member while cloaked deleted the initial second tent and did not say anything to me so I assumed I was still too close to the door so thus I moved spawned in one further from the doorway. I was then frozen and the third tent was deleted. After sitting frozen for awhile I was brought into a sit where I was confronted and told I was going to be banned for "Prop Abuse". This was changed and alternated multiple times from Prop Minge to Prop abuse, I asked how spawning them in was prop abuse/minge and the admin replied that it was abuse for the reason being that I spawned it into the city hall. I agreed and went on to state that I would not spawn it in there anymore now that the confusion was handled. The staff member did not agree and went on to scold me and tell me that I was going to be banned and that it doesn't matter if I don't do it anymore. He stated that I've "already done it". After going back and forth for a little, I believed we came to a conclusion to my best knowledge. Unfortunately while I was speaking my game froze and I was disconnected for "Too many voice packets". I attempted to rejoin but as I did I was met with a banned screen. Now I believe I should be unbanned because I have spoken with Monaclu about if it was infact prop minge / abuse to spawn in a tent in city hall; he then stated it was not. And as for the matter of Leaving to avoid punishment, It was not in my ability to stop the matter of my disconnect.
