Jmoorsey, Honestly as you're constantly spamming tickets with 'former staff btw' you should know better as a former staff member! You "attacked the wrong person" and then attempted to rdm the guy with the hammer and got you killed, even if there was a clip to prove it was not rdm due to some what reason, you still broke NLR and you returned to the scene with your bike within 2 minutes to intentionally run them over and you were laughing about it! Don't think you should be unbanned and consider yourself lucky that it was only a 3d ban you received 3 notes in a span of 5 days. You say he kept coming up to you and calling you names, that's true but not one of those times did you follow proper escalation rules, you just beat him with a hammer every single time he called you a nigger. You also say you never killed him yourself, logs say differently. You also dropped a bunch of hammers outside of the Corsican building so you could get other people to beat him with a hammer every time he called you a nigger.

Id like to clarify that he kept coming up to me and calling me names. I never looked for him just so I could kill him. I also never killed him myself, I had always followed server rules during those encounters by hitting him a couple of times.

Hi. I am the member of staff who banned you. You were on a massive minge spree and to be completely honest I should have banned you earlier in the day for your earlier actions which was repeatedly RDMing a guy because he called you a nigger. However, I didn't punish you nor did any other member of staff who was online at the time. What you were banned for is everything seen in this clip. You were harassing a lot of people throughout the day and just overall being a nuisance to everyone on the server. You're quite lucky to get such a short ban considering you also were noted multiple times in the past week for VDM & RDM.

Hello! First, I understand not everyone has fully gone through and read the rules of our server. Ignorance does not give you immunity from them though. As shittor quoted, you can in fact be PK’d for LTARP in the case of more serious felonies. In your case, you were facing (minimum before any investigation) Dangerous Conduct with a Weapon and Attempted Murder. Both of those are pretty serious felonies so that box has been checked. On top of this, you were still offered to continue the RP after actively choosing to disconnect, reconnect, and start playing on another character. These actions show us clearly you knew exactly what you were doing. Even seeing this the PK’ing admin gave you an explanation of what continuing the RP would entail and you chose repeatedly to not partake in the RP at all. This is what lead to your PK. When informed of this you then tried to argue for just banning you for LTARP instead of a PK and that is not a behavior we want to support or precedent we want to have. Hello, I'm the administrator who approved this Permakill for your character, Lorenzo Fernandez. The reason you were Permakilled is that you disconnected to avoid a felony. I tried bringing you to a sit to talk about the incident, but you decided to leave the server. I then waited for your return and noticed you had switched to a different character to avoid the felony. I brought you to a sit and discussed the in-game court process with you, which you decided you didn’t want to pursue. You refused to switch back to the character to continue the roleplay and instead asked to be banned to circumvent the felony charge. Here's a section from the PK guidelines explaining that you can be permakilled for disconnecting. "If you intentionally disconnect to avoid an arrest that would have been a significant felony OR you simply AFK / refuse to engage with the arrest roleplay you may be "auto-plea'ed" by staff which can result in a prison sentence PK." Going to try and be unbiased here, but to my knowledge its bro's first offence, and he is an active member that is still relatively a new player that has only played the last couple of months. I know its not my call to make, but maybe cutting him a break and giving him a ban instead of the PK would be an act of mercy and be his one get out of jail free card moving forward and be a reminder that if it happens again he knows what will happen. I just went through server and pk rules on the forum and did use the "find" tool and typed in LTAP and personally didnt find anything beyond the word punishment being used for LTAP but it seems intentionally vague. Im sure whatever decision that gets made will be fair. But I guess asking to throw the guy a bone and show him some grace is really all he can ask for.

I want to apologize for that and I know how it affected the RP for others, and I take full responsibility of my acts.

This falls under quite a niche spot in the rules, as a result many staff members were confused given the validity of the PK. You were pk'ed following this rule: ■ Breaking Fear RP while being detained by Police. If the police are detaining you for a crime and you break FEAR rp by pulling a weapon on them the NYPD are still within their right to react in self defense. This can and will be considered initiating a violent confrontation with police EVEN if you never managed to fire the weapon. Which can have possibly caused some misconnections or confusions. We know in this situation you did not initiate violence on the officer (You never attempted to shoot), you were not under fear RP nor were you being detained, as well as having put the gun away. While the cop is not faulted for having shot you, it should not have been a PK. We apologize for the inconvenience, that being said you need to be mindful when pulling a weapon out.

The rules surrounding a cop initiating the gun fight invalidating the pk only apply to the person to which the officer shoots, as long as they have not broken fear RP or initiated a shootout with the officer first. An example would be: A man is running away from police. Police officer opens fire on him. He is now free to retaliate against that officer without the risk of PK. However; in this case the officer had a valid reason to shoot your friend, and you are to begin with not your friend. This protection does not apply to you. You saw your friend get shot by a cop, and you shot at the cop and lost. This is a valid PK, you should not shoot at cops who have not shot at you. Hello, Unfortunately I was the one that administrated the PK on your character. To begin with, I would like to apologise for this PK being a little delayed. I understand that you were told by two different admins that you wont be getting PK'd as a result of this situation and getting killed from it 2 days later can be frustrating. So for that I apologise. Now to get to the whole point of this appeal. The reason why your character was PK'd was due to it being deemed that the chances of you accidentally pulling out your weapon whilst your friend/factionmate is getting arrested is highly unlikely, more probable that you had intentions on shooting this officer in defense of your friend.

Hello! After reviewing with other staff we have come to a decision. While we do agree there was some level of conflict going on between you two, we don't view any of these as inherent rule breaks by you especially worthy of a ban such as this. For the RDM bait, we reviewed logs and found there may have been a slight case of mistaken identity but you did in fact have a valid reason to be upset with him. You were ran over by another player multiple times prior to your interaction with the ticket maker. Logs show then the ticket maker hit you with his car several times leading up to where his clip begins. For the LTAP, this has also been deemed to be false. The ticket that was initially made wasn't even against you. It was for the man in the other truck. We have no reason to believe you left maliciously following the time stamps of when the ticket was made, claimed, and you leaving. To top everything off, it would appear the ticket maker did not make the ticket till he attempted to resolve the issue himself in game. He pulled his gun from the ATM, attempted to execute the driver of the other truck, failed, and was killed for it. This is when he goes to type out multiple different ticket claims before settling on 'vehicle minge'. When situations are an IC conflict we want them to be handled IC, if they are OOC or rule breaks then we will step in as needed as staff. In this case, he attempted to use staff to get back at someone for an IC conflict that he was on the losing end of and we do not want to set that as a precedent way to handle things. What server rule or PK rule was violated?: I believe I should be un-PK'd as the situation that my character was killed over was a complete accident and I did not initiate actual combat. I don't dispute that I pulled out the weapon and it was generally pointed in the direction of Senior Officer Benedetto Porcello but this was an accident, and as is evident in the Clip below I immediately put the weapon away and made *no* attempt to attack or threaten the officer. It is blatantly clear that no genuine attempt was made to initiate combat on my part, but despite this the Officer immediately escalates the situation by gunning me down (Once again, after my gun is already away and there is absolutely no threat to his life). Furthermore, the situation that lead to me PK happened on the 15th of July, it is now the 17th and my character has only been killed tonight. I was told adamantly on the 15th during a sit with Yuki that I would not be getting PK'd because it was clear that the situation was an accident. Although I don't believe the original reason is valid either, I also believe it is extremely unfair to wait two whole days before acting on this despite previous staff members who were looking after the situation stating that it was not PK'able and that I had nothing to worry about. Had this just been decided at the time I would take no issue but leaving me ignorant to the seemingly ongoing debate over my character potential PK was unfair, especially considering when the PK did eventually go through I was left totally unaware until I got onto the game and found out myself. To conclude, the actual PK aside the time it took and lack of genuine communication around my characters death was very disappointing.
