Honestly this happens pretty often. After sitting down and getting back up, or after getting run over by a car, basically anytime you get knocked into a fallover state and then stand back up, your whole body turns invisible except for your head hitbox. After a little while it fixes itself, or you can type record 1; stop in console and it instantly fixes it. Long story short, the bug usually happens after a fallover or after sitting down and standing back up. It isnt considered a Fail Mug. It's just not a smart thing to do. If you try to put someone under FearRP while they're already holding a gun in their hand (even with the safety), FearRP doesn't apply to them. That means they can attempt to defend themselves without the risk of being PK'd. However, if they manage to kill the muggers, the muggers will be PK'd. So while it's definitely a risky and unwise mug attempt, BUT it isn't a Fail Mug. Short answer to the question in the topic is No. If someone tries to apply FearRP on you while you already have a gun in your hand and attempts to mug you, you are allowed to defend yourself without the risk of being PK’d. However, if you manage to kill the attackers while doing so, they will be PK’d.

I never denied any of the points you made. The issue is that, according to the RP rules, the fact that the guy's intentions may have been obvious doesn't change anything. He had the right to make the first move, and you can't kill someone based on what you think they're about to do. For you to legally kill someone, they need to give you a reason by becoming an Active threat. The fact that he would most likely have tried to kill you doesn't give you the right to kill him before he actually attempts anything.

I understand all that. The point is that, in a situation like that, the guy you killed had the right to make the first move. Just because he was holding a gun with the safety on doesn't automatically mean he was going to try to kill both of you. You never gave him a chance to escalate the situation or do anything at all. You killed him because your friend had just killed his friend, and you assumed he was about to shoot both of you. The problem is that you can't know that for sure. At the moment you killed him, he was an Idle threat, not an Active threat. That's exactly why multiple staff members ruled it as RDM.

Tim Burr got unbanned because the staff member who banned him didn't realize he had already been noted by Monaclu for the exact same incident. Hello, I'm somewhat involved in this situation, so I'd like to share my perspective. First of all, he is not lying. Someone from our faction falsely told them that we had issues with Jewish people and that we had ordered them to take care of some Jewish guy, which is completely false. At the time, they were brand new to the server, just a group of friends looking for something new to do. Obviously, being lied to doesnt justify Mass RDM or breaking any server rules. They should have known better and made sure they understood the rules before acting. That said, they were new to the city and genuinely didnt realize that what they were doing was against the rules. Because of that, I believe they deserve a second chance to prove they are not minges(NITRP). They are aware of the mistake they made, they've acknowledged it, and they are willing to make things right. Long story short, I dont think there was any bad intent here. They are good people who made a stupid mistake, and i believe they deserve another chance. +1

Look, just because he has a PO doesnt mean he is going to cheat again. He was banned for being in a cheating Discord, but that doesnt necessarily mean he was cheating on "Diverge". Personally, I don't really care what he did on other servers what matters is whether he actually cheated here.

If he didnt cheat on Diverge, I dont think this should be a permanent ban. +1 from me. You shouldnt ban somebody just because they were in a Discord server that had cheaters in it

If im not mistaken, you got unbanned because you had already received an RDM note for that situation and the staff member who banned you didn't realize it had already been handled by another staff member. They cant punish you twice for the same incident, which is why you were unbanned, not because it wasnt RDM. Otherwise, Matador would've been unbanned as well.

Your Turkish fella here. I had the chance to get to know many people in this faction including its founder, through the Bambozzini family. They are all friendly people and most importantly, they genuinely care about roleplay. I have personally witnessed how long they've been working and putting effort into this application together. I haven't seen a cartel on the server in a long time, and considering their dedication and the amount of work they've put in, I think they absolutely deserve a chance.
