Reason for appeal (dispute/apology): Well, he openly disrespected us on the streets in his car. Since he was openly disrespecting us, we decided to punch his car. 

Why should you be unbanned?: Well, considering he was being a disrespectful guy and went out of his way to do it, I believe we had all the rights to punch his car. He took 0 damage from us punching his car from what I saw. He could have driven off at any time but didn't. He got out of his car instead of just driving away. Again he was talking shit to us and went out of his way to do so.

Banning Staff member here, You screamed out "Is that Pearce" which even with him being a "Known" person, you wouldn't know his Character and you haven't had a formal introduction with this character as his Pearce Character was PK'd, you didn't have his name, and this is what caused him to pull over, and at that moment you guys started punching his vehicle, even returning to punch his vehicle after the guy in blue was pushed away, and he ran him over, and got out without being hostile and approached you, you then pulled a Gun on him, and shot him. I asked for a second opinion from a Admin, who also agreed with the RDM/ RDM Baiting, in which you also have Post Offenses for both.

Hi Vethar, I was the one you killed in this situation. 

There is a way to escalate this situation appropriately. 

Your logic does not apply to how the rules work. What you are saying is, "He used words to disrespect us, so kill him." This is the prime example of RDMing. There was no direct threat to you, nor to your partner. Both of you went out of your way to block my vehicle; and subsequently hit my car for no reason. Similarly to how no damage was done to me, no harm was done after being run over. 

However, you went out of your way to take your firearm out and kill me, while not posing any threat to you. It doesn't change the fact that you RDM'ed. Rather if both of us took guns out while aiming at each other/having it off safety or pistol whipped one another, then you and I would be getting into a fight that wasn't breaking any rules. Instead, you just posted an RDM clip and an RDM bait. Similarly, you somehow knew who I was without having my recognition or my name in game; essentially, you bring OOC knowledge into the game and use it for your IC bias.

If you watch my clip, you can notice how I did nothing to provoke you to shoot your firearm at me. However; through appropriate escalation, you could take your gun out and place it on safety; pistol whip or whatever. 

You were banned for RDM = Random Death Match, Killing Players without valid reason. There is no valid reason for you to take out your firearm against me, thus resulting a ban.

Let's break this down. 

In the video, you block my vehicle. You hit it after I disrespect you. I tell you both to stop, and that is continued. I ram over the individual, not inflicting any damage. I step out the vehicle to confront you about the situation, and you wait, take out your firearm, and kill me. *Again, this is baiting. You are baiting to shoot me.* And because I have died, it was considered as RDM. 

 

1. If someone is loitering/following/harassing you you may give them warnings to leave you be, if they ignore several warnings and continue you may attack/kill them. (One warning will not suffice, multiple warnings in a very short time span will also not suffice, you have to give them time to react.)
   *You have not given any warning to leave.* 
    
2. Likewise if someone runs you (pedestrian) over / hits you with their car intentionally you may kill them. However, if it was an accident or incidental car clipping and was not intentional, be reasonable and don't kill them.
3. You may not attack/start confrontations with people in order to kill them when they defend themselves. This is considered baiting.
   
   Additionally, I wasn't following you guys; rather, you all were following me. 

Ways to Identify someone IC'ly:
  -You have their F3 *You don't.*
  -They Identify themselves to you, verbally giving you their full name / unique nickname *We never met, you somehow knew Pearce but my name does not include Pearce. Nor have we ever encountered each other in Roleplay with my character.* 
  -Someone who has their F3 Identifies them to you. *According to both your clip and your partners, the both of you didn't have my recognition.* 

In your friend's clip on 00:27, you can see me slowing down, and your friend runs in front of my vehicle to make me stop. (It appears he may have tried to get himself VDMed.) VSync may have been a small issue, but you can see I was trying to still drive, but couldn't because your friend came infront. My initial reaction would be to stop. 

At the end of the day, this to me looks like your argument is "I got disrespected, so I will take my firearm out and shoot the guy while I have the chance because I forced him to do something." And this, again, is the prime definition of RDM Baiting. 0:25 of your clip, you can see me walk out the vehicle with no firearm in my hand. Essentially, I wasn't an active threat to you, and you went out to still shoot me down.

To add onto this, in your clip 0:03 Seconds; How did you and your friend take out hands at the exact same time without giving each other a mutual understanding you would hit the car? This looks a lot like you metagamed this to be in unison with your partner.

Sorry for the delay, after some discussing I've came to the conclusion to lift your ban from your account. I came to an agreement this was properly escalated.
You two were getting verbally disrespected by Pearce in the vehicle and you guys decided to follow him, since he was driving at walking pace, you guys ran up and started punching the vehicle which is part of the escalation. Since you can't really damage Pearce you guys roleplayed it out by doing damage on someones belongings (his car)

In the video you provided you started the escalation yourself, you insult them and their reaction is them 'chasing' you since you're driving at walking pace through little italy and they have any right to confront you about it (also because UA and Commission is in the middle of a conflict) now that I looked back at it, to me it looks like YOU (Pearce) were hoping for some sort of reaction out of it, since you did not drive off.

You were escalating it yourself and didn't really make an attempt to get away after you disrespected these men. You could've reversed with the vehicle and went on a different direction, since the guy with the christmas shirt was infront of your vehicle. You backed off and what it looks like to me is intentionally ran him over and said "Ight bet" which was a proper reason for them to kill you.
You insult them, they respond by punching your vehicle after some words exchanged you ran one of them over and they kill you. 

Regarding the metagame accusations it's very hard to proof if they were metagaming in a vc which will be looked at. The other infractions they will be talked to about it but to me is to minor to give a punishment for, a nickname goes around the street and more between it
