Why should they be returned?: Because im  kinda new to the server and when i was killed at first everything was fine for 30 minutes until all of the sudden an admin pulls me and tells me im getting pk'd and i get sent to hell.

Reason for PK: attempted kidnapping where i fought back and died in the process

Why should you be unPK'd? What server rule or PK rule was violated?: im new to the server and when  i was pkd i was fine for 30 minutes then all of the sudden a admin pulls me and says im getting pkd with no explanation. i only get a explanation when i make a new character and put in a ticket on the server.

well you've been told why and also you were being mugged and you turned around and started attacking the guy with a that had a gun  pointed at you make 

so you broke fear RP. New or not you should be reading the rules

While yes, you did break FearRP and that does warrant a PK in this situation. You got lucky because the person who mugged you, was deemed a mugging character a couple hours after you were killed. You should really read up on the PK rules, especially breaking FearRP, a little recap is that if someone is mugging you, or giving you commands, under fearrp, the second you retaliate and die, you can be pked for that.
