What server rule or PK rule was violated?: i believe that the pearson who shot me had 3rd party help in this fight due to him knowing when we pulled back and where we were, additionally he extremely quickly snapped to mine and my partners exact locations to kill us. during the initial attack they were staying in their base however the moment we started to pull back they started to follow, he followed over to my position where the moment he peeked the corner he was able to shoot and kill me. he then walked away to go back inside to where he also killed my partner in a similar fashion by very quickly snapping to his spot up on the train tracks. Main points are him knowing our locations and movements and snapping onto us while shooting. What server rule or PK rule was violated?: I should be unPK'ed because the individual who killed, Char ID 160706, seemed to know exactly where everyone was going in that entire raid. There was some sort of hacks used in this situation to know exactly where the hitters were. When we were about to attack, the opposing side, at roughly 4:00 AM CST, decided to hop on to protect the property. Originally, there was just Marciano Altoviti, who was to be the target. Immediately after we had 5-6 people on a roof far away from the warehouse, they loaded in 3-4 more people.. With no one around the area except the individuals inside the warehouse, they kept baiting to attack the warehouse. When we make an attempt, all of a sudden, they load people into the server to prepare right away. There was no way to really tell if we were going to attempt an attack unless you were able to see through walls how many people were planning an attack. Subsequently, there was only one Altoviti on at the time, who continued to switch on and off characters, which we took note of. Initially, we pushed into the warehouse and attempted a hard push. We decided to flee back, and as we fled back, they attempted to push in the same second we fled. In this instance, you would want to scope out and wait to see if the area was clear before attempting to fight back. But they knew exactly where my other hitter, Tristano, was, as well as when I tried to swing back, where I was. In my push, I have a video that shows I spotted our target through the peaks of the train track and took a general note of where he walked to without even looking at the tracks. In that same second, he immediately guns me out by turning around, aiming directly at me, and killing me. I noticed the target at 00:14. 00:18 I take a general guess to estimate where he would walk to and take note of last position. At 00:22 somehow he locks on and finds out exactly where I am, seeing me directly. Exactly on that same second of 00:22, he shoots me on the head and I die. According to the staff, they were watching these fights. this was the initial concern in the beginning of it all, "They are most likely going to use hacks." As soon as we stood infront of the property, they baited by expressing heavy activity through rumours. While the argument could be made that "He heard you", it seems odd that the entire fight he knew where two attackers were, and when it was the right time to push when we left with zero hesitation. I appreciate the message back about this. Yeah that is valid! It is hard to go about defending someone who has been permad before and again. I can understand how notes can leave a bad impression personally, and have seen how sometimes Admins use it for personal shit to be honest. In my opinion, an unban should go through but I'm not gonna lie, this really should be the last straw. You have to be very careful about everything you would do if you get un permad. Anyways that's my imo

I have a very mixed opinion for this ban. As much as I really like Chief Sosa and want to see him unbanned because of how funny the guy was, in the administrative perspective it is very difficult to justify unbanning someone who has been perma'd 2+ times and there being genuine proof for the unperma. At the same time, I want to vouch for Sosa because his appeal seems apologetic; once again. How would you ensure that these bans don't happen again? It feels like the same mistake may happen in the future and that the appeal wouldn't have been all the worth if that was the case.

"Including one po for item transfer." Now that is the issue in my opinion, if it is true he has a previous offense for Item Transfer I would say -1 to his appeal.

+1 I don't know about his extensive but if he had Extensive POs for item transferring? Obviously he shouldn't be let back. But if he has pos for other warns not related to I.T. then he really should be given a shot since three months passed by. In my opinion I'd look at this by a (if he item transfered before than obviously him doing it again doesn't mean he is sorry.) but from the sound of it it looks like he did it one time. (?) I wouldn't have this guy permad if that's the case, it seems like he should be given a chance. This is important to note, if his POs were for Item Transferring then obviously he shouldn't be let back in. But if it is for other situations not related to I.T. then I don't see how given the guy a chance hurts. Just my I.M.O. since he is permad right now.

-1. I don't see this player as someone who would handle situations based off of respecting the server rules; rather I've seen this player minge a majority of the time. It doesn't seem befitting to the community as a whole in my opinion.

+1 This guy being perma banned for years on end seems a bit much; however granted he attempted to try to levy the ban through different means by attempted connections on different steam accounts, It doesn't look like he has a history and even then that was about three years ago. Anyone new probably wouldnt have known the risks. Imo I would give him a shot and if he screws up then the punishments would be heavier.

I don't recognize Patch's voice, and frankly I don't really care. I don't understand why you are framing this as "I wanted to go out after patch and kill him" when I had no idea it was Patch in the first place. You didn't even post the RDM clip in the sit.

I had no idea Pierre was Patch until you told me in the sit. I heard the police officer ask "Who is Pierre" and Pierre responded with "I'm Pierre." I don't recall opening a ticket to PK Pierre. Please show where I made that ticket because I don't believe I did. There is no reason to. I named it GambinoK after you told me that was Patch, and to be honest it's pretty funny how you are changing up what I said. I never sent you this clip in game, as you claim I did. Check the logs and copy the link. This is a blatant lie. This clip is public and widely available. Yes I changed the name, and I will check to see if I can show proof as to the log and time of changing. I don't find how that is relevant to you not providing me clips of my RDM. I posted the clip after I found out it was Patch, after you told me in the sit. I have NO WAY of knowing that was Patch until you told me in the sit that was Patch . I don't recognize his voice because we don't communicate at all. You still took the ticket of your own faction member and that doesn't change anything. You told me this was Patch and I put two and two together realizing this was a botched ban. In addition, I never sent you this video. Check the messages I sent in the game in LOOC or in chat. We had no idea that was Patch until you brought us into a situation and directly told me that was Patch. Why else would we want to chase some random guy down? He caused issues, got us into shoot outs, had members locked in his room, of course he is gonna be met with hostility. You are trying to pose me as some bully who purposfully targeted Patch, when I don't even know the guy. Without a doubt I have a history of these notes. Just as how nuisanced this note is in addition to other notes I have received, this situation is a whole lot worse. You are just targeting me because I'm a Colombo main. Notice in that clip how three or four bullets were shot and not a whole mag. His tire was popped. Again another lie. If I wanted to, I would have mag dumped an entire clip and he would have been dead. I used a Mac 11 and tend to use my mag dumping technique to kill someone. I use semi automatic for targeted shots, specifically in this situation to pop tires. Not to kill. Same situation. It was three shots. Another lie. You said in the sit you removed his note after asking Yokai what my name was. And we both demonstrated we knew each other's names. I wasn't being annoying for thirty minutes. I was explaining, on my end, that I had NO Idea that was Patch until after you told me. And I said this in the sit. After you told me that? It all made a lot of sense. I decided to make a clip of me killing Patch because, haha funny killing banter. But if I KNEW that was Patch, I would have made that really clear and apologized. I'll gather any extra evidence if I can, as at the moment I'm at work. I watched the video you sent me in dms again. I don't see where you are getting at with that, and you have no way of seeing if I watched the video or not. I just went onto my factions discord and found the video and rewatched it.

How was any of these lies? There is proof to all of this. My faction member being stuck in a room while informing me he is kidnapped by biker gang can be proven by the message in radio chat. Logs show. I watched your video, you havent sent me the RDM clip in the situation. You sent me a clip of me chasing and shooting a tire out. You took your faction member's ticket. Pierre is Patch, whom of which you told me that I had no idea about till the day of the sit. I gave a very detailed description as to what happened and it can be proven with logs. I don't have any intention to lie at all. I'm just saying exactly what happened. I have no history of lying, nor do I plan on creating that history if I want to continue to maintain a strong representation of myself in Diverge.

This encounter had started originally when my faction member informed me on radio that he was kidnapped in Ghetto Room 3 by "a biker gang member." Of course, I rushed into action to get my member out. OOCly I took note of the name of the person who owned the room 3 at the time, something with a "Jean Dr.Pierre" when I recall correctly. Police showed up and asked for a Dr. Pierre (whoever owned the door.) Within the vicinity, I heard that statement and heard Pierre say that he owned the door. Looking at his character, he wore the SOS jacket that carried the patches. Throughout this entire encounter, I was under the strong assumption that this was an affiliate with SOS, our allies, who was causing issues for our members such as kidnapping our guys. In my defense, I utilized the proper escalation; reasoning that someone wearing SOS colors and biker jacket, should be stopped because of that disturbance. As we fast forward, a Takahashi member whom I've had the name of, and of course vice versa, informed me that this Pierre also had one of his interns. In both of our interests, we chased down Pierre and demanded him to stop his vehicle for ten minutes straight. I shot his tires out and confronted Pierre at the Car Dealer, as we demanded Pierre to stop, Yokai (The Takahashi member I recognized), was ragdolled and picked up by the same person who fled with Pierre before they died. Yokai sent the shots off first, and I proceeded; mind you we aimed at their tires. The intention wasn't to kill and was to pop tires, it still killed Pierre who begun to flee and the person who picked up Yokai's ragdoll. (This is what the RDM x2 comes from.) In the sit, Byte pulled Yokai and I into the situation and asked why we were chasing Pierre down, to then we explained Pierre, someone wearing SOS colors and Biker Jacket, was causing issues with us that we had to stop. We explained we followed escalation appropriately. At first, without any questioning, Byte noted Yokai for RDM. Then he asked Yokai and I if we had each other's names, to which we did and displayed we recognized each other by saying each other's names. Byte then removed Yokai's RDM note, and kept me in the situation. Byte let go of Yokai, who was in the same situation as me. Instead, Byte tells me that I did all of this because Pierre is Patch (whom I had no idea it was Patch up until Byte informed me it was Patch.) Byte explained that Patch's voice was easily recognizable. I'm sorry but I've learned my mistake from Metagaming and intend not to do that again. Furthermore, I simply don't recognize Patch's voice or use bias to specifically targets people because they are in a different faction. It's odd however, when you take the ticket of your own faction, let go of someone who did the same actions as me (which we argue wasn't RDM), but give me the burden because you know I'm Pearce (for whatever reason.) None of that should have mattered in the first place, I simply tried to correct someone who we assumed was SOS because he was wearing SOS uniform, and my faction member informed me it was the biker gang who kidnapped him and had him locked in Ghetto Room 3. At the sit, I asked them to send me a clip of the RDM, and all they provided was a clip of me and Yokai chasing Pierre and the ragdoller person and shooting the tire out, but not killing them. Byte simply said "Well it shows in the logs Pearce so you're gonna take a vacation." And that was it. To me this isn't fair when I don't receive clear evidence as to why I'm being banned when I asked them directly for it, and all I was provided was "Here is a clip that doesn't show a death." And "The logs show it so you're banned." To me, this really isn't fair. (Edit the addition of why I should be unbanned because for whatever reason my phone didn't put this portion down. I'm doing this while at work so I apologize.) Why should you be unbanned? I believe I should be unbanned because this situation stemmed based off of an honest misunderstanding and misjudgements of the situation. The player I chased, Pierre, was wearing SOS colors and the SOS jacket, which led me to believe that he was in fact SOS. And though he was not apart of the friend group for the SOS members on at the time, we still believed he was in the faction. My intention was never to kill, however to cut off the tires of the vehicle which, after three bullets or so, killed Pierre and the passenger in that moment. I am under the strong premise that I was not given sufficient information of my ban at the time of the sit. I was only provided, at the time, a clip of the chase, not the specific clip of the death. I was told by Byte that "the logs show it." In my opinion, I feel that this was too harsh of a punishment. RDM entails intention, and my intention was not to kill, rather disable. In the clips any party provided, you can see that I am not mag dumping into Pierre, rather carefully shooting spots. Otherwise, if the vulehicle blew up or I had mag dumped, then it would be very clear I was RDMing especially with intent. In my RDMs, if I had done something I knew was wrong, I would accept my punishment and not argue against punishments; which has happened in my previous notes. I firmly believe that this was not RDM at the time because I believe I followed escalation. Mind you, my faction's new alliances are new, so information to me is also new regarding allies. I appreciate the read through it this case of course. It would be helpful if we looked at this as a community; because mistakes can happen. These 2 kills was an absolute mistake, and not on purpose in any way. I want to, once again make clear, that I had no idea at the time that Pierre was Patch, who is against my faction. I had no way of figuring out if this person was Patch, rather I chased him because of the issues he had caused with my faction members and friends by locking faction members up in Ghetto Room as an example. I followed all of this information ICly and the logs can prove my reason for intervention when my member asked for my help and clearly identified where he was stick in Radio chat.
