Your appeal boils down to the following points: 1. I stopped when asked. 2. It's not harassment because I stopped when asked. 3. It's not harassment because freedom of speech lets me accuse him of being a pedophile for no reason There's no acknowledgment of wrong doing, no acknowledgment that accusing people of shit like that is not chill, etc etc. Point 1 and 2 are contested by multiple staff members who say you continued despite being told to stop, you argued with JMZ and continued after the fact despite claiming you instantly listened as well as arguing in the second sit (refusing to comprehend your actions, a consistent theme) You don't seem to grasp the severity of making baseless accusation, yes as a one time joke these comments are whatever, but to continuously, after being told to stop, try to besmirch someone simply because you don't like them or you think they might not like you is irresponsible as hell. Anyone can claim anything but without actual proof you're just hurling baseless libel, which obviously isn't "Freedom of Speech". This isn't the first time you've gone out of your way to harass people you have issues with, I have seen the way you behave in personal messages with people, your overall attitude isn't very much different than a spoiled rich child. I've seen you crash out about when being made to leave factions or for getting pk'ed. You have on multiple occasions professed your 'hatred' of persons in the community and claimed you could easily go find them, maybe to harm them, etc. Harassing or other factions on alternate characters, you have already been reported for this poor behaviour and I wanted to see if this was a one time crash out or indicative of a repeated pattern of schizophrenia. Ultimately this proves it, I liken your behaviour to that of a child. It's a video game server, you get too invested, too emotional, you ascribe issues in roleplay to that individual's character as a person and bring the beef OOC constantly. It's embarrassing. I think the permanent ban here is appropriate, if this harassment of Riggs was the only issue with you I honestly would not mind reducing the ban, but based on your inability to take responsibility, the other past threats and harassments, concentrated efforts to damage factions on alt chars and the very suspicious arrests you were making on your PD char I think Boomroasted's decision to extend this to a permanent ban is more than justified. I don't know how old you are or why you behave the way you do but I think you need a serious period of self reflection, not only to realize what you did was wrong and why but to actually fundamentally change who you are as a person, because as it stands it does not seem enjoyable to be around you. Consider this an intervention. You may re-appeal this ban in a few months. Incase you don't understand why I am denying this appeal ATM, read here: I think your have a problem with your anger and emotions, I think you lash out verbally when things do not go your way, in RP, related to staff, in DMs, regarding money. I think it's immature and a negative trait and to allow you to continue to behave this way is damaging for the people you interact with and your own well being.

I hear you, but if you read what I said just above what you said. I just said it shouldn't have been said. I reacted out of anger based on how he was treating me and thats not okay. Not once did I justify the comment said, as it was wrong. I justified it being classified as harassment, as I stopped the negativity asked of me to be stopped. I will send my formal apologies regardless of the appeal decision, I am just confused how you dont see me trying to take accountability at all?

I could care less about the effort you put into trying to justify your actions, at the end of the day your actions were wrong, and were harassment PERIOD. I am done commenting on this appeal, as you still have not taken a single once of responsibility, or are in way taking anything I am saying to heart. You are deflecting the blame, and I'm done sitting here trying to bang my head against a wall trying to get you to understand that your actions were wrong, and you should take responsibility. My appeal has been much more than " My ban is unfair, I did nothing wrong." can we please be for real? if you look at other ban appeals, and see the effort I put into making sure I genuinely didn't break any rules, you can see the difference. harassment is the repeat offense, I stopped after JMZ pulled me. I 100% had nothing left to say about that subject, and am perfectly fine with saying It should have been said. however in the rule itself freedom of speech is literally stated, I made him uncomfortable and for that I'm sorry. However when made aware, I DID INFACT STOP. Maybe I don't know you well, but I'm basing everything off of this situation, why? because its all I know? It does seem very bias, as like I mentioned above I DID NOT harass him. You know what you are... a criminal, he kept arguing that I had no reason to arrest him. I did. multiple. I was sent back from a sit, and continued the rp. No comments made about the metagame knowledge? or how he started the interaction? Didn't think so...

Biased? Again, you are not the victim here, you are the harasser. I have and will always get involved in any and all situations where someone is accosting another member of this community especially with unfounded claims, the kind of claims which spewed from you. Clearly you don't know me, as I am one of the most unbiased staff on this server, and have even gotten after Drunken on several occasions. You clearly know exactly what you meant when you said " You know what you are" because Drunken was still upset at you for what you did. So continue on calling me a liar, JMZ and Drunken can both back me up in these claims. Again, no apology given to the true victim here, Drunken. Playing the victim card is "My ban is unfair, I did nothing wrong", which is what this appeal is, you say you are not deflecting responsibility, yet have not even acknowledged that anything you did had some degree of malfeasance.

Hi BoomRoasted, I’m not sure what you meant by “playing the victim card,” but I want to be clear. I’m simply trying to explain my side of the story, not deflect responsibility. That said, I do feel there’s a level of bias here, as it "appears" like there’s a personal connection between you and Drunken, which may have influenced how the situation was handled. Regarding the screenshot from ix_crazy (the guy who has nothing to do with this) he only nudges in just like mr nova when it benefits him, or when they can instigate something and exaggerate it. I want to clarify that there’s nothing in that conversation that shows I was trying to dig up anything incriminating. I had simply mentioned that I was permabanned for calling Drunken what I did, and when the conversation turned toward the “AI” comments, I backed off and stopped messaging further. I recognized that it was heading in the wrong direction and chose not to escalate. You just admitted to me saying "You know what you are" in the aspect of what Boom. Lets be real here, as soon as we got back to the cells I was straight RPing and had NO intentions or continued conversation of what I was told to stop doing. He was a criminal, and was trespassed. No other words were said beyond that point. These messages are as old as my ban, I messaged the group maybe at most 20 mins after my ban, so yes, very much still the heat of the moment if you ask me. When you pulled me into the sit you gave me less than 10 seconds to talk for myself, or explain the situation. Biased as all get out man, cant hide it.

Alright here we go. . . First stop playing the victim card, its not becoming. You clearly have not grasped Global rule number 2, nor did you stop when you were asked to stop, I was watching over the interaction and you clearly stated as you were using the Jail NPC " You know what you are", this was after drunken had told you to stop and JMZ had gotten involved. I brought you to a sit, and asked you what you were doing/thinking, your first response was to accuse me of protecting Drunken, as if I was covering up some big conspiracy. Every interaction in which you don't get your way has resulted in the same response, you got suspended from Tactical, you launch into a whole tirade, again playing the victim card. This was more than a "I made a harsh comment", this was intentional verbal harassment that you even tried to dig up more evidence to get Drunken banned. I was given the evidence below in which it appears you were trying to dig up dirt on Drunken, see screenshot provided. Yes, I do know who was involved in this conversation and have reached out to each person individually. So no it was not "a heat of the moment" issue, you clearly have motive to go after Drunken with no evidence to support any claims and once you are told to stop, you didn't. This whole finger point, and no accountability is frankly appalling, and on top of that you decide to insult staff who was trying to diffuse the situation. I will make it clear that we do not tolerate these insults, there is no place in this community for anyone who even thinks that this is acceptable behavior. You have no accountability for your actions, you don't make any form of an apology towards Drunken, which shows your behavior hasn't magically changed since I banned you.

Hello this was a perm ban so i can comment i was also the Lawyer for Nubsniping when this happened. You where banned for Global rule 2 which in fact isn't the privacy rule but is the Harassment rule. You where banned for this for comments you made in LOOC. From the screenshots sent by the user in diverge general (That Reported you) your behaviour was VERY out of order. Claiming that this player is in your words a "Child Molester" Your ban was valid you let the situation get out of hand you said something that goes against the harassment rules there fore you where banned if you really want to play the server you shouldn't have done what you did mate

Yes, Drunken. As mentioned above when I told the whole entire forums why I was banned It wasnt harassment, as when I was told to stop, I did. However you continue to harass everyday and get away with it. Did you not remember how you started the interaction? Its posted above for you. Id like to mention the metagame of knowledge he shouldnt have at the very end of my clip too. @Boomroasted he mentions my ESU suspension and he knows this how? This was PRIOR to my comments. He has an issue with me because I stand my ground against him, and not like everyone else who shells up and hides from riggs.

Thats how you get alot of money, by being smart with it. Adding on to my original dispute, as I was wrong with the rule alignment. Based on Global Rule 2 as written, I genuinely don’t see how my behavior qualifies. I made a harsh comment during an in-game conflict, yes, 100% but the moment JMZ told me to stop, I stopped. I didn’t repeat the word or continue pushing the insult. If my tone came off as sarcastic or sharp afterward, that wasn’t me trying to continue harassment, it was me genuinely pissed off at the situation, it was well over an hour dealing with that, its not fair to say Drunken is innocent here at all, nor is the perma ban fair. It was me holding my ground, but still respecting the line that was drawn. “Harassment” is a continued behavior, I 100% lost all negativity towards that man post sit with JMZ. He however continued to egg on the situation as soon as I was returned. Not trying to go tit for tat here, im being as genuine as I possibly can be. Freedom of speech is literally acknowledged in the rule itself, I was made aware to stop, and I did. I tried moving on from the situation as swiftly as possible, Plea had been written for 30-45 minutes. This was well drawn out, and I had all the grounds needed to arrest the man. He used his power and relations to get me in trouble. as simple as it is. Again, I made no further targeted remarks, and went on about the RP. A perma is beyond harsh here. After you told me to chill, I went back and strictly continued the RP for the charges and thats all. You know its true, because you were there.

You immediately disagreed, and started talking over me, and saying you were going to report me, saying I was incorrect, making me have to gag you for you to understand your wrongdoings. Reason for appeal (dispute/apology): dispute, and an apology. Why should you be unbanned? I want to start by acknowledging that I was originally pulled into a sit by JMZ and asked to stop calling another player (Drunken) a “child molester.” I complied without hesitation the moment I was told to stop. There was no argument besides freedom of speech, no further escalation on my part after that point. I respected the instruction from staff immediately. The comment itself came during a heated moment after dealing with "Drunken" (Riggs, Morello, or however you know him). He came to the pd station instantly on dirt with me on his lawyer char, because on his Detective char he so badly wanted to get me fired. He came in instantly telling me how things were going to happen, and started telling me vulgar things about myself and how I did my job(he gets mad because things dont get handled his way) Consistently engaging in strange behavior uncalled for 100%. frequently surrounding himself with much younger kids in-game, and me mentioning that to him shouldn't hurt his feelings, when he quite literally gets on and says the hard R everyday. While the phrasing I used may have been out of line. I based it off of many observed in-game interactions and not tied to any real-world doxxed or private information. I never revealed any names, personal info, or actual private details. I do not believe this can be reasonably classified as a “privacy” violation. Global rule 2 is clearly defined as not releasing restricted private information, I did not reveal anything private nor did publicize anything to anyone with an intent to ruin his image. Making a provocative statement back to defend myself may be aggressive on my end however is not leaking someone's private data. Drunken, the player involved in the incident (Martin Riggs, Morello in this case), has a known reputation for relentless trash talk, hostility, and even targeting. He came into NYPD actively stirring the pot, disrespecting my role as an officer, and calling me names. Yet, his behavior seems consistently overlooked, while I deal with the harshest possible punishment, a perma ban. Not once did I justify what I said, I did say freedom of speech, as I'm not wrong in those regards, I did stop everything trash talking when asked to. But guess who didn't, Drunken. As soon as I take him out of his cell when I came back from the original sit with JMZ, he instantly started talking heavy trash again. Its allowed on his end, he can call me anything in the dictionary, and get away with it. I’ve been an active part of the community for a good amount of time. While I’ve had a couple of RDM-related issues in the past, I’ve never been involved in anything like this. I’ve contributed positively to the PD, helping with patrols, training, and assisting newer players regularly. My involvement in this server has been consistent, however I have recently been trying to work on not being such a crashout, and working along side certain people in the PD has helped that. Tremendously. I’ve been an active member of the community for quite some time. not nearly as much time as the likes of someone like Drunken (I have 3weeks played) While I’ve had a few slip-ups in the past related to RDM, I’ve never been involved in anything of this nature. Lately, I’ve made a real effort to shift how I carry myself in game. I’ve been consistently contributing to the PD helping with patrols, assisting new players, and supporting training efforts. Working alongside certain members of the PD has honestly helped me grow out of that “crashout” mindset, and I’ve been making progress because of it. Admittedly, I was on a temporary suspension from my ESU badge due to an incident where I deployed tear gas without orders and mouthed off during the situation. I owned up to that and had been actively working to get myself back on track, both in terms of attitude and discipline. With the goal of earning back my place as a reliable and effective operative. Unfortunately, that progress is completely gone now, not because of another genuine mistake, but because of clear favoritism and bias. It’s crazy to see personal relationships with admins and UA, override actual growth and contribution to the city. As for the global rules, here is why I didn't break any of them. Rule 1- Harassment / Hate Speech (Drunkens favorite one to break) -I did not use any racial, homophobic, sexist, or any other discriminatory words. -I did not look to create any violence with any individual involved, only matching the hateful energy that was brought into the PD by Drunken. -What I said was an opinion based on the player’s in-game behavior. While it was blunt, it wasn’t targeted hate or harassment. -I stopped immediately when asked, showing my willingness to de-escalate, Drunken did not. Rule 2- Privacy (THE RULE I WAS BANNED FOR) -Not a single bit of personal information was leaked in the event, at any point in time. -My comment was based on in game behavior made in an ooc form because I was on duty, and he wasnt on the char he kept claiming to be. He was on morello, kept saying "its riggs" -Nothing was “doxxed” or “leaked,” nor was there any effort to expose in OOC about private details. (even if he was 100% a convicted pedo, nothing was made of a real life scenario, not once) -Accusations or insults, even harsh ones, made during our gameplay ooc or not, do NOT meet the threshold of a privacy breach under this rule. Rule 3- Advertisement -n/a Rule 4- Impersonation -I did not impersonate anyone. In fact, another player, Drunken was claiming to be martin Riggs, when he was on his Morello luchesse char. I know this rule isnt necessarily linked to this form of impersonation, however he did use this to his advantage with other officers and lobbied them against me. Rule 5, 6 , and 7 all N/a. Even the spamming part, I stopped when asked. Immediately. All I ask is that this situation be looked at fairly, not through the lens of personal grudges or double standards. I’m not saying my phrasing was ideal, but I am saying that a permanent ban is excessive, especially when I complied with the original staff request and didn’t actually leak anyone’s private information. I also would like to apologize to BoomRoasted for calling you dumb, and JMZ for saying you are the most hated staff member, those comments were made in the heat of the moment and were undeserved. If a shorter ban or a warning is more appropriate, I’m willing to accept that and move forward.
